In the settlement, the Sheriff's Office also agreed to send Sgt. John Walsh to training on the state and national criminal information systems.

Walsh was chairman of the five-deputy board that reviewed Tutko's case.

He was singled out for more training because when he found out Eliason had filed a lawsuit, he used the criminal information system to look up Eliason and see if he had any previous convictions, Mogensen said.

The database is supposed to be used only for investigating crimes; it is not intended to help deputies do background checks on people who sue the sheriff.

Misusing the criminal information system is a crime.

The Sarasota County Sheriff and Internal Affairs investigators have refused to open a routine Internal Affairs Investigation into the shooting death of Tyler Spann.  Following an independant review by the Sarasota Herald Tribune, who supported Sheriff Tom Knight, it was determined that mistakes made by Deputy Carlos Verdoni did not cause by likely lead to the Spann's death.  Verdoni, who was later involved in an on-duty altercation regarding the incident and subsequently disciplined, was never tested for drugs or alcohol eventhough he claimed to be injured during the attack.  This failure to do so contradicts requirements put forth under the laws of Workers Compensation. 

All that being said, the Sheriff's refuses to budge on his decision not to conduct an internal investigation of Verdoni actions.  An investigation which would like provide education and training that could prevent future unnecessary shootings.

Sarasota County Sheriff's Office Internal Affairs Investigation 2010-052 outlines a complaint made to investigators regarding an inappropriate relationship between veteran Patrol Lieutenant Kevin Mcelya and his subordinate Sergeant Brigit Liebenberg.  The complaint, made by Sgt Liebenberg's estranged husband Mike, details an alleged ongoing affair beginning when Sgt Liebenberg was assigned to Lt Mcelya. Mike states that he overheard telephone conversations between the two, read emails, reviewed cell phone records and even found twitter conversations in which the Sgt and Lt exchanged pleasantries.

The Sheriff's Office open it's investigation into the allegations of "Conduct Unbecoming" and "Fraternization" on July 19th.  Sgt Liebenberg, who was only handled as a witness, gave her statement to investigators on the same day.

On the morning of Monday July 20th, Lt Kevin Mcelya was summoned to the Sheriff's Office by Captain Jeff Bell.  From the audio/video provided of this investigation, it appears Lt Mcelya met with Bell prior to taking a polygraph examination.   

During the polygraph examination, conducted by Sgt Jeremy Borntreger, Lt Mcelya was asked a multitude of questions -- one of which referenced Mcelya touching Sgt Liebenberg (his direct subordinate) in a sexual manner?  After reviewing the results of three seperate polygraph examinations, Sgt Borntreger concluded that Lt Mcelya was being disceptive.  An independant and seperate evaluation was conducted Sgt Kevin Pingle.  Pingle's results were the same as those of Sgt Borntrager.  The Polygraph Report, authored by Sgt Borntreger, clearly depicts a testing conclusion of "Deception Indictated".
